The third and final complainant to testify in the Jian Ghomeshi sexual assault trial admitted Monday that she was 'deliberately misleading' police when she failed to mention she had a sexual encounter with the accused not long after he allegedly sexually assaulted her in the summer of 2003.

The witness, who cannot be identified under a court-ordered publication ban, testified that she and Ghomeshi were kissing on a bench in a Toronto park in July 2003 when he suddenly squeezed his hands around her throat and began to smother her.

After detailing her account of the alleged incident and her relationship with the former radio host, the witness faced intense cross-examination by Ghomeshi's lawyer Marie Henein, who accused the woman of "lying" to police when she gave her initial statement in December, 2014.

The witness told the court that on Thursday, she accidentally heard something about the trial on CBC Radio, inadvertently disobeying the judge's order not to follow the proceedings.

She said she heard something about "emails" and then realized that everything "was going to come out."

The next day, she said she decided to go to investigators to update her statement so that prosecutors would not be "blindsided" by details they had never heard before.

Henein said the information the witness came forward with on Friday detailed a sexual encounter she had with Ghomeshi at her home following a date on a night not long after alleged assault.

"The thing you wanted to tell (police),” Henein said, “was when you went to that bar on King Street, Mr. Ghomeshi came home with you and then you messed around and gave him a hand job.”

The witness said she didn't believe that detail was relevant to the case when she first spoke to police.

"You speak to the police and you are asked and you tell them, 'I never had sex with him,'" Henein said.

"Did you think that masturbating him and messing around with him was something that would fall within that category?"

"It wasn't sex," the witness responded.

"Intercourse is what I meant."

On Monday morning, the witness, who was 32 at the time of the alleged assault, testified that she had known Ghomeshi “in passing” for several years when he approached her at a dance festival in Toronto in July 2003.

She told the court that she was speaking to a group of people following a performance at the festival when Ghomeshi came over to her and rested his arms on her back.

When the group asked how she knew Ghomeshi, the witness said he replied, "‘Oh, we’re engaged.'"

“It was a familiarity that was surprising to me,” the witness testified.

During the festival, she said she and Ghomeshi went out on a date at a restaurant on The Danforth and some time after the dinner date, she said she saw him once again at park where the festival was taking place.

She said after the performances had ended, the two were alone on a bench near a baseball diamond in the park.

While they were kissing, she said she suddenly felt his hands on her shoulders and “his teeth.” Shortly after, she said his hands were around her neck.

“He was squeezing,” she added.

"At that point, his hand went up around my mouth and then there was nothing about this that I wanted to be a part of. It didn’t feel safe or sexy.”

She told the court that she remembered getting up at some point and leaving to go home.

Despite the alleged assault, the witness said she decided to go out with Ghomeshi again for dinner and then for drinks at a bar on King Street afterward.

“He would have called me. He is very charming. You second guess yourself. You think… he is being really nice… maybe I misread it. Maybe if I give him another a chance, maybe it will be different,” she said.

The romantic interactions with Ghomeshi came to an end at the beginning of August, she said, after the two had a fight at a party regarding one of her friends.

“My exact words (to Ghomeshi) were ‘You’re f****** crazy. Lose my number. Don’t ever call me again,’” the witness told the court.

She told police that after their fight at the party, she made a point to keep her distance from Ghomeshi and only interacted with him at public events they were both attending.

But during cross-examination, Henein grilled the witness about that claim.

Henein presented an email the accused sent to Ghomeshi in February 2004, which ended with the line, "Still want to have that drink sometime?"

Henein said the complainant also invited the accused to her brother's stag and doe.

Another focus of Henein's cross-examination was the witness' relationship and communication with one of the other complainants, actress Lucy DeCoutere.

Henein said the two exchanged 5,000 messages between Oct. 29, 2014 and Sept. 23, 2015.

Just hours after telling the court that she had never discussed details about her allegations with DeCoutere, Henein produced messages between the two that proved the contrary.

“I guess I did,” witness conceded.

The defence lawyer said they also discussed the conversations they had the Crown, the ex-radio star's court dates and their shared "hate" for Ghomeshi.

In one comment the witness made to DeCoutere, she wrote, "It's time to sink the pr**k."

In another message she sent to the Trailer Park Boys actress, the witness said, "I want so badly for the piece of sh** to pay for what he's done."

The two also joked about wanting Ghomeshi to "get fat" and "get bald."

Henein concluded her cross-examination of the witness on Monday afternoon.

Crown prosecutor Michael Callghan said he intends to call one more witness, who resides in Nova Scotia. Due to inclement weather, he said he may not be able to fly the witness in until Wednesday or Thursday.

When the trial resumes at 10 a.m. on Tuesday, Henein will argue why the court should not hear the new witness' testimony.

Ghomeshi, 48, has pleaded not guilty to four counts of sexual assault and one count of overcoming resistance, choking in connection with the case.
