Tenants in a pair of downtown condominiums where panes of glass fell this summer are launching two class action lawsuits.
The suits have been launched in the Ontario Superior Court of Justice on behalf of all owners and renters of condominiums in Murano Towers near Bay and College streets and Festival Tower near Adelaide and John streets.
The plaintiffs in both suits allege the defendants are responsible for the lost use of their balconies, which were closed in August after several instances of falling glass were reported.
In one of those instances a woman was struck by glass while walking near Murano Towers and transported to hospital.
"Outdoor living space in downtown Toronto sells for a premium and is an integral part of condo life," Sharon Strosberg, a partner at Sutts, Strosberg LLP, said in a press release. "The developers promoted the sale of these units by emphasizing the sizeable balconies and terraces, but the class members have been unable to use their outdoor living space for over a year with no end in sight".
The defendants named in the Murano Towers action are Bay Grenville Properties Ltd., Lanterra Developments Ltd., Toro Aluminum Railings Inc., architectsAlliance and H&R Developments Inc.
The defendants named in the Festival Tower action are King and John Festival Corporation, The Daniels Corporation, KPMB Design Inc., Kuwabara Payne McKenna, Blumberg Architects, Kirkor Atchitects and Planners, Toronto International Film Festival Developments Inc., Toro Aluminum Railings Inc. and Toro Glasswall Inc.
