The provincial Special Investigations Unit has charged an OPP constable with assault in relation to a nighttime incident that occurred on the shoulder of Highway 401 last summer.

The SIU says that prior to 12:30 a.m. on July 1, a 19-year-old Oshawa man was driving south on Highway 400 when he started to experience car trouble.

He pulled his car over on the south shoulder of the eastbound collector lanes of Highway 401, east of Jane Street, a short while later.

The SIU says two OPP officers attended the scene of the breakdown.

During their interaction, the motorist was injured and later diagnosed with a concussion, the SIU says.

Const. Scott Hearnden is facing one count of assault causing bodily harm.

He is scheduled to appear in court at 1000 Finch Avenue West sometime on Feb. 10, 2016.

The SIU is called in to investigate any incident involving death,, serious injury or an allegation of sexual assault involving police.
