A pre-trial hearing for the father and son charged in connection with a violent altercation involving TTC enforcement officers at Union Station in January has been set for May 6.

Defence lawyer Bruce Daley appeared in court on Wednesday on behalf of Jamie and Russell Gillman, who are both charged with assault in connection with the incident, which took place on Jan. 29 following a Leafs game.

A video of the altercation which surfaced online at the end of March showed one enforcement officer attempting to apprehend one male civilian while a second man punches another enforcement officer in the back several times. At one point, one of the enforcement officers is seen repeatedly punching the younger of the two men in the face. Both the civilians involved in the altercation are eventually arrested by the officers.

While the YouTube video only shows a portion of the altercation, the TTC captured CCTV video that is expected to provide a clearer picture of what went on that night. Daley, who represents Jamie Gillman, says he has not yet viewed the surveillance video but expects it will be part of the disclosure package.

“My client is exceedingly confident that there will be nothing on that video that will ever support a criminal conviction,” Daley told reporters outside the courthouse at Old City Hall Wednesday.

Neither of the accused appeared in court.

“They are frustrated and they are impatient and they want to move this matter along but they understand that there is a process in place and we respect that process,” Daley said.
